This End User Agreement ("Agreement") governs your use of the account portal and registration platform ("Platform") accessible at your organization's subdomain (e.g., yourcamp.campium.com), which is powered by Campium LLC ("Campium," "we," "us," or "our"), a New York limited liability company located at 85 Livingston St., Suite 17D, Brooklyn, NY 11201.
This Agreement applies to parents, guardians, and other adult individuals ("you" or "End User") who create an account, log in, or submit information through the Platform on behalf of themselves or a minor participant. You must be at least 18 years of age to create an account.
By creating an account or using the Platform, you agree to be bound by this Agreement. If you do not agree, do not create an account or submit information through the Platform.
The Platform is a technology service provided by Campium to camps, schools, after-school programs, and similar organizations (each an "Organization") to manage registration, forms, communications, and related program administration. The Platform is branded and operated by your Organization; Campium provides the underlying technology.
Campium is not affiliated with, and does not control, the programs, activities, policies, or decisions of your Organization. Any questions about enrollment, fees, program details, refunds, or scheduling should be directed to your Organization, not to Campium.
To use the Platform, you must create a personal account using accurate, current, and complete information. You agree to keep your account information up to date. Each individual should maintain only one account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access to your account, notify your Organization immediately. Campium is not liable for losses resulting from unauthorized access caused by your failure to secure your credentials.
You may log in to your account at any time to view, update, or correct information you have previously submitted. Some information may be locked by your Organization after submission; contact your Organization directly if you need to update locked fields.
You agree to provide accurate, complete, and truthful information when completing forms, registration materials, and any other content submitted through the Platform. You are solely responsible for the accuracy of information you submit.
If you are submitting information on behalf of a minor (a person under 18 years of age), you represent and warrant that:
By submitting a minor's information through the Platform, you provide consent on that minor's behalf for the collection and use of that information as described in this Agreement and the Campium Privacy Policy.
If you are submitting information about a child under 13 years of age, please read this section carefully.
The Platform may collect personal information about children under 13 as submitted by you on their behalf. Under the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6508, Campium and your Organization are required to obtain verifiable parental consent before collecting personal information from or about children under 13.
By submitting information about a child under 13 through the Platform, you represent that you are that child's parent or legal guardian and that you consent to the collection, use, and disclosure of your child's information as described in this Agreement and the Campium Privacy Policy.
Your rights regarding your child's information under COPPA include:
To exercise these rights, contact your Organization directly. You may also contact Campium at [email protected]. Campium will not condition your child's participation in any program on the collection of more information than is reasonably necessary for that participation.
Certain forms may request health, medical, or other sensitive information about you or your minor participant. This information is collected by your Organization through the Platform for program administration purposes (such as medication management or emergency care). Such information is encrypted in transit and at rest and is accessible only to authorized personnel at your Organization. Campium does not use health or medical information for any purpose other than storing and making it available to your Organization.
If your Organization has executed a Business Associate Agreement (BAA) with Campium, your health information may qualify as Protected Health Information (PHI) under HIPAA. In that case, your Organization's HIPAA Notice of Privacy Practices governs how your PHI is used and disclosed. Contact your Organization for a copy of their Notice of Privacy Practices.
If you make a payment through the Platform (such as registration fees or tuition), that payment is processed by your Organization's designated payment provider. Campium is not a party to payment transactions between you and your Organization and does not hold, process, or have access to your payment card or bank account details.
All questions about fees, charges, payment plans, and refunds should be directed to your Organization. Campium has no authority to issue refunds or adjustments on your Organization's behalf.
Information you submit through the Platform is collected and used by your Organization to manage your enrollment, communicate with you, and administer the programs you are participating in. Your Organization's own privacy practices govern how they handle your information. Contact your Organization directly with questions about their data practices.
Campium accesses your information only as necessary to operate and maintain the Platform on your Organization's behalf. Campium does not sell your personal information, use it for advertising, or share it with third parties except as required to provide the Platform or comply with applicable law.
Campium may use aggregated, de-identified data derived from Platform usage to improve the Service. This data cannot be used to identify you individually.
Campium's collection, use, and handling of your personal information is governed by the Campium Privacy Policy, available at https://policy.campium.com/privacy. The Privacy Policy describes in detail how Campium handles the personal information of adults and children, including Campium's practices with respect to children's data under COPPA. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.
Because your information is submitted to and managed by your Organization through the Platform, requests to access, correct, or delete your personal information should be directed to your Organization. Your Organization controls what data is retained, for how long, and whether deletion requests can be honored within the program context.
Campium will cooperate with your Organization in responding to data requests in accordance with applicable law. If you have questions about your rights under applicable privacy law (such as the California Consumer Privacy Act or the New York SHIELD Act), you may also contact Campium at [email protected].
For parents and guardians of children under 13: your rights to review, correct, and delete your child's personal information are described in Section 4.3 above. These rights apply in addition to any other privacy rights you may have under applicable law.
For minor participants who turn 18: if your information was submitted through the Platform while you were a minor, you may contact your Organization or Campium at [email protected] to request access to, correction of, or deletion of your information upon reaching age 18.
You agree to use the Platform only for its intended purposes and in compliance with all applicable laws. You shall not:
The Platform and all underlying software, design, and content are owned by or licensed to Campium LLC and are protected by applicable intellectual property law. You are granted a limited, personal, non-transferable license to use the Platform solely for the purposes described in this Agreement.
The Platform may contain links to third-party websites or services. Campium is not responsible for the content, availability, or practices of any third-party site. Use of third-party sites is at your own risk and subject to their own terms and privacy policies.
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CAMPIUM MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED, ERROR-FREE OPERATION. CAMPIUM IS NOT RESPONSIBLE FOR THE ACCURACY OR COMPLETENESS OF INFORMATION SUBMITTED BY YOU OR YOUR ORGANIZATION.
Because some jurisdictions do not allow limitations on implied warranties, these limitations may not apply to you.
TO THE EXTENT PERMITTED BY LAW, CAMPIUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING ANY LOSS OF DATA OR LOSS OF ACCESS TO YOUR ACCOUNT.
CAMPIUM'S TOTAL LIABILITY TO YOU ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE FEES PAID BY YOUR ORGANIZATION TO CAMPIUM IN THE ONE (1) MONTH PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Notwithstanding the foregoing, nothing in this Section shall limit Campium's liability for:
Campium is not responsible for the actions, decisions, or policies of your Organization. Any claims related to your Organization's programs, enrollment decisions, refund policies, or use of your data should be directed to your Organization.
Because some jurisdictions do not allow limitations of liability for consequential or incidental damages, these limitations may not apply to you.
This Agreement remains in effect for as long as you maintain an account on the Platform. Your Organization may deactivate your account at any time. Campium may suspend or terminate your access to the Platform if you violate this Agreement or if your Organization's account with Campium is terminated.
Upon termination of your account, your ability to access previously submitted information through the Platform will cease. Contact your Organization if you need copies of your submitted records before account deactivation.
Termination of this Agreement does not affect Campium's obligation to honor any outstanding COPPA deletion requests submitted prior to termination.
Campium may update this Agreement from time to time. We will notify you of material changes by posting the updated Agreement on the Platform and, where appropriate, by email. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Agreement.
This Agreement is governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
Before initiating any formal legal proceeding, you agree to contact Campium at [email protected] and attempt to resolve the dispute informally within thirty (30) days.
This Agreement and the Campium Privacy Policy constitute the entire agreement between you and Campium regarding your use of the Platform and supersede all prior understandings on that subject.
If any provision of this Agreement is found to be unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
Campium's failure to enforce any provision of this Agreement does not constitute a waiver of its right to do so in the future.
